Apple v. Samsung Trial (May 2014): Professor George Foster
Analysis Group and academic affiliate George Foster of the Stanford Graduate School of Business were retained by Samsung Electronics and its counsel, Quinn Emanuel Urquhart & Sullivan LLP, to provide consulting and expert witness services in this patent infringement case widely covered in major media outlets. Professor Foster's report analyzed the strategies employed by leading smartphone manufacturers that had the greatest impact on marketplace outcomes. He concluded that recent U.S. smartphone market share shifts were largely driven by marketplace participants' major strategy choices, as opposed to minor device software feature choices. Based on these insights, Professor Foster concluded that Apple's damages analyses substantially overstated the degree to which Samsung's smartphone sales were attributable to the use of the patents at issue. After finding infringement, a San Jose, California jury ordered Samsung to pay $119.6 million in damages, far short of the $2.2 billion sought by Apple.
