Central Vermont Public Service Corporation and Green Mountain Power Corporation v. Entergy Nuclear Vermont Yankee
Analysis Group was retained by counsel for Entergy in a dispute with Vermont utilities regarding two generation capacity reduction events (“deratings”) that occurred at the Vermont Yankee nuclear power plant. At issue was whether the utilities suffered economic damages arising from the deratings under a long-term power sales agreement between the parties. Analysis Group's team, including Principal Todd Schatzki, supported testimony by Analysis Group Senior Advisor Susan F. Tierney regarding economic damages. Dr. Tierney's conclusions reflected a financial analysis of the long-term power sales agreement in light of the plant performance during the incident and replacement power costs, the agreement's requirements, the plant's performance over the course of the agreement, and the reasonable expectations arising partially from the regulatory framework in which the contract was enacted.
