Dang v. San Francisco Forty Niners, Ltd. et al.
Analysis Group was retained by counsel for the National Football League (NFL) in this consumer class action. The plaintiffs alleged that the NFL's exclusive licensing deal with Reebok for the manufacture of NFL-branded apparel drove up prices, causing consumers to pay “anti-competitive overcharges” for merchandise they purchased. Plaintiffs sought damages for California consumers and injunctive relief for consumers nationwide. The Analysis Group team led by Managing Principal T. Christopher Borek, and including Vice Presidents Peter Simon and Federico Temerlin, supported our affiliated expert, Randolph Bucklin. Professor Bucklin rebutted opinions by two of plaintiffs' experts. Professor Bucklin showed deficiencies in one expert's consumer survey and survey results, and critiqued another expert's proposed method of measuring overcharges. The case settled prior to a court ruling on class certification.
