Drivers v. United Parcel Services, Inc.
In a series of ongoing matters, UPS employees in California claimed they were misclassified as exempt and failed to receive overtime pay or meal and rest breaks. While the class was decertified, some 50 plaintiffs elected to pursue their claims individually. An Analysis Group team led by Senior Advisor Bruce Strombom used detailed information from UPS's timecard, delivery management, and vehicle maintenance systems to evaluate whether conditions which would qualify UPS for the FLSA's Motor Carrier Exemption were met and to calculate damages.
