ERISA Class Action

Analysis Group worked on behalf of the defendant in an ERISA class action matter in which participants in the company’s stock fund sought recoverable losses as a result of the fund’s decline in price. Our role in this engagement included an analysis of the degree to which the company’s stock was a prudent investment, a comparison of the percentage of plan assets invested in the company stock fund to the percentage of assets invested in the company stock funds of other 401(k) plans, and a careful review of analyst reports and commentaries concerning the risks and returns of the company stock.
