Heuft Systemtechnik GmbH v. Industrial Dynamics Co., Ltd.

Analysis Group was retained by Knobbe Martens Olson & Bear LLP to assist its client, Industrial Dynamics Co., Ltd., in a patent infringement suit brought by Heuft Systemtechnik GmbH. At issue in the trial was the infringement of a technology used for optical inspection of bottles on a filling line. The Analysis Group team, which included Managing Principal Jeffrey H. Kinrich, helped defense counsel critique the opposing expert's damages analysis, demonstrating that the expert unreasonably relied upon unsubstantiated documents and information that eventually were deemed inadmissible by the court. Initially, the judge had denied without prejudice the defense's Daubert motion to exclude the opposing expert's testimony, but following the testimony agreed to strike it in its entirety. As a result, the judge ruled that the plaintiff's damages claim suffered from a failure of proof. The case proceeded only on liability issues. Judgment was ultimately entered in favor of Industrial Dynamics on liability because it was found to not infringe the Heuft patents.
