Innovation Sciences, LLC v. Amazon.com, Inc., et al.
Analysis Group was retained on behalf of Amazon.com, the defendant in a patent infringement suit brought by Innovation Sciences (“IS”). IS alleged that Amazon’s smart home technology, including Alexa voice commands through its Echo products and the Echo’s communications with smart home devices, infringed IS’s patents. IS sought more than $100 million in damages.
The Analysis Group team was led Dr. Keith R. Ugone, and supported by Vice Presidents Minh Doan and Alex Fiore. Dr. Ugone filed an expert report and testified at both deposition and trial. After analyzing usage and consumer demand for the accused features, related licenses, and other factors relevant to the commercial performance of Amazon’s products, Dr. Ugone and the Analysis Group team rebutted the plaintiff’s claimed royalty damages calculations. Dr. Ugone also presented an alternative royalty opinion consistent with these analyses and based on prior licenses to IS’s patent portfolio.
A jury in the US District Court for the Eastern District of Texas found that IS failed to prove that Amazon had infringed any of the patents-in-suit. It also found that the asserted claims of IS’s patents described routine technology, and hence were invalid.
