Lynne Houserman v. ComTech Telecommunications Corporation, et al. and Telecommunication Systems Inc. v. Lynne Houserman, et al.
Analysis Group was retained by Calfo Eakes on behalf of Lynne Houserman, the defendant in a breach of contract action and the counter-plaintiff in an employment litigation brought against ComTech Telecommunications and its subsidiary, TeleCommunications Systems (TSYS). ComTech and TSYS alleged that Hauserman violated the restrictive covenant in her contract with TSYS by working for a competitor following her termination. Hauserman claimed that a subsequent agreement with ComTech superseded the terms of her previous contract and did not contain any non-compete provisions. Hauserman further alleged that ComTech wrongfully terminated her employment and discriminated against her based on her gender.
An Analysis Group team led by Vice President David Smith and Manager Rosamond Mate supported Managing Principal Mark Gustafson, who submitted an expert report and testified at deposition. Mr. Gustafson assessed damages, including an estimation of the loss of future salary and bonus payments, as well as unexercised stock options.
Hauserman relied on Mr. Gustafson’s analyses to secure a favorable settlement.
