Pat Cason-Merenda et al. v. Detroit Medical Center et al.

An Analysis Group team including President Pierre Cremieux and Managing Principal Dov Rothman supported affiliate expert Edward Snyder on behalf of the defendants in what is commonly referred to as the “Nurses Antitrust Litigation,” whereby plaintiffs accused defendant hospitals of conspiring through information sharing to depress the wages of registered nurses. In addressing whether the fact of injury and damages for each member of the proposed class could be determined using a common method of proof, the Analysis Group team combined qualitative research on the defendant hospitals with empirical analysis of the defendants' human resources data, including a massive set of payroll data, to show, for example, that nurses with the same sets of observable characteristics (e.g., level of education, age, experience, tenure, etc.) were paid widely different wages at the same hospitals. The matter subsequently settled.
