Pirnik v. Fiat Chrysler Automobiles NV, et al.
Analysis Group was retained on behalf of Fiat Chrysler Automobiles (Fiat), the defendant in a securities class action suit. The plaintiffs, representing a putative class of shareholders, alleged that Fiat made false and misleading statements and material omissions concerning its compliance with federally mandated vehicle emissions regulations, and concerning its substantial compliance with relevant global regulatory requirements.
An Analysis Group team led by Managing Principal Andrea Okie and including Managing Principal Emily Cotton and Vice President Atang Gilika supported Professor Daniel Esty of Yale University, who filed an expert report and testified at deposition. Using his experience as a former federal and state environmental regulator, Professor Esty explained relevant Environmental Protection Agency (EPA) emissions regulations and industry custom and practice with respect to assessing compliance with environmental regulations. He also evaluated the nature and type of communications between the EPA and Fiat during the at-issue time period. The case settled.
